Welcome to Sunday Moments.

Sunday Moments is operated by Leah Rosemary Dempster, ABN 50 442 420 327. The terms “Sunday Moments”, “we”, “us” and “our” refer to Leah Rosemary Dempster trading as Sunday Moments.

These Terms of Service apply when you visit our website, use its features or purchase products from Sunday Moments. Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services.

By using our website or purchasing a product, you agree to these Terms of Service and our Privacy Policy. Please do not use the website or purchase our products if you do not agree to these terms.

1. Eligibility and information

You must be legally capable of entering into a purchase agreement. If you are under 18, you should obtain permission from a parent or legal guardian before making a purchase.

You agree to provide accurate, current and complete information when placing an order. You are responsible for ensuring that your email address and payment details are correct.

2. Products

Sunday Moments currently offers digital products, including printable guides, workbooks, checklists and other downloadable resources.

We make reasonable efforts to describe and display our products accurately. However:

  • colours may vary between screens, devices and printers;
  • product previews may not show every included page;
  • printing results may vary according to the printer, paper and settings used; and
  • minor design improvements may be made from time to time.

A product’s main features, format and inclusions will be described on its product page.

3. Orders and payment

Placing an order is an offer to purchase a product. An order is accepted once payment has been successfully processed and we provide confirmation or access to the product.

Prices may be displayed in Australian dollars or another local currency depending on your location and the market settings available through our website. The currency and final amount charged will be clearly displayed at checkout.

Please review your order carefully before completing payment. Because digital products may be delivered immediately, we may be unable to cancel an order after the download has been supplied.

We may cancel or decline an order where:

  • payment cannot be processed;
  • an order appears fraudulent;
  • incorrect pricing or product information was displayed;
  • the product is unavailable; or
  • accepting the order would breach a law or platform requirement.

Where we cancel an order after payment, we will provide an appropriate refund.

4. Digital delivery

Digital products are normally delivered through a download link, confirmation page or email after successful payment.

No physical item will be shipped unless a product page expressly states otherwise.

You are responsible for:

  • entering the correct email address;
  • checking spam, junk and promotions folders;
  • using a compatible device and PDF-reading software; and
  • downloading and securely saving purchased files.

Please contact us if you do not receive your download or experience a genuine technical problem.

5. Personal-use licence

Purchasing a Sunday Moments digital product gives you a limited, non-exclusive and non-transferable licence to use it for your own personal purposes.

You may:

  • download the product to your personal devices;
  • print reasonable copies for your own use; and
  • use the product for your personal reflection, planning and intentional-living practices.

Unless we have given written permission, you must not:

  • share the product or download link with another person;
  • email or distribute copies to friends, colleagues, clients or groups;
  • upload the product to a shared drive, website or platform;
  • sell, sublicense or redistribute the product;
  • remove Sunday Moments branding or copyright notices;
  • claim the product or its content as your own;
  • modify the product for resale;
  • reproduce substantial parts of it in another product; or
  • use it for commercial, organisational, classroom, coaching or group purposes.

Separate permission or licensing may be required for schools, workplaces, groups or organisations.

6. Intellectual property

Unless otherwise stated, all content available through Sunday Moments—including written content, downloadable resources, graphics, illustrations, photographs, branding, product designs, frameworks and website content—is owned by or licensed to Sunday Moments.

Your purchase gives you permission to use the relevant product under the personal-use licence above. It does not transfer ownership of any intellectual property to you.

7. Refunds and consumer rights

Purchases are subject to our Return and Refund Policy.

We do not ordinarily provide refunds for change of mind after a digital product has been delivered. However, nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

Please contact us if a product:

  • cannot be accessed;
  • is corrupted or defective;
  • is materially different from its description;
  • was supplied incorrectly; or
  • otherwise fails to meet an applicable consumer guarantee.

We will assess the issue and provide an appropriate remedy where required.

8. Wellbeing disclaimer

Sunday Moments products and website content are intended to support general reflection, planning, intentional living and everyday wellbeing.

They are not:

  • medical or psychological advice;
  • counselling or therapy;
  • diagnosis or treatment;
  • crisis support;
  • legal or financial advice; or
  • a substitute for advice from a qualified professional.

You are responsible for deciding whether a product is appropriate for your individual needs and circumstances.

Sunday Moments does not promise or guarantee any particular health, emotional, relationship, professional or personal outcome.

9. Acceptable website use

You may use our website only for lawful purposes.

Third-party websites and services are governed by their own terms and privacy practices. We are not responsible for their independent content, availability or practices.

Any concern about a product purchased directly from a third-party retailer should be directed to that retailer.

Sunday Moments is powered by Shopify, which enables us to provide the website and store services.

Sales made through our store are made directly between you and Sunday Moments. Shopify is not the seller of Sunday Moments products and is not responsible for fulfilling your order or resolving product-related concerns.

Nothing in this section removes any rights you may have under applicable law.

12. Website availability and errors

We aim to keep our website and product information accurate and available. However, we cannot guarantee that the website will always operate without interruptions, delays or technical errors.

We may correct genuine typographical errors, inaccuracies, product descriptions or pricing mistakes when identified.

Where an error affects an order you have placed, we will contact you and provide an appropriate resolution.

13. Limitation of responsibility

To the extent permitted by law, Sunday Moments is not responsible for loss arising from:

  • use of a product contrary to its stated purpose;
  • unauthorised sharing or modification of a product;
  • device or software incompatibility that was disclosed before purchase;
  • temporary third-party platform or payment outages outside our reasonable control; or
  • reliance on general wellbeing information as professional advice.

Nothing in these terms excludes or limits liability, consumer rights or remedies that cannot lawfully be excluded or limited.

14. Changes to these terms

We may update these Terms of Service when our products, website, business practices or legal requirements change.

The current version will be published on our website with its updated date. Changes will not unfairly remove rights relating to purchases already completed.

15. Governing law

These terms are governed by the laws of Queensland and the applicable Commonwealth laws of Australia.

Nothing in this section limits any mandatory consumer rights available to you under the laws applying in your country or region.
